Dower & Maintenance

Dower (Mahr) and maintenance are critical aspects of Islamic marriage law in Pakistan, governed by The Muslim Family Laws Ordinance, 1961 and The Family Courts Act, 1964.
1. Dower (Mahr):
  • The husband is legally obligated to pay Mahr to the wife, as stipulated in the Nikahnama. Mahr is a mandatory gift, which can be paid immediately or deferred.
  • Failure to pay Mahr can result in legal action, where the wife can claim her due amount through the Family Court.
2. Maintenance (Nafaqah):
  • Maintenance refers to the financial support provided by the husband to his wife and children during the marriage and, in certain cases, after divorce.
  • Under the law, the husband is required to provide financial support for the wife during the iddat period (waiting period) and for children until they reach adulthood.
  • In case of dispute, the court can determine the amount of maintenance based on the husband’s financial capacity and the needs of the family.
