Adoption & Fostering

Adoption and fostering in Pakistan are governed by Islamic traditions and The Guardians and Wards Act, 1890.
1. Adoption (Hifz-e-Tifl):
  • Adoption as it exists in many Western countries is not recognized under Islamic law; instead, a form of guardianship is practiced where a person assumes responsibility for the care and upbringing of a child.
  • Legal guardianship can be obtained through a court under The Guardian and Wards Act, 1890.
2. Fostering (Kafalah):
  • Fostering involves temporarily caring for a child who is not biologically yours, typically through arrangements with charitable organizations.
  • Although fostering is allowed under Islamic principles, the guardian must ensure the child retains their biological lineage and identity.
