Custody & Guardianship

Custody and guardianship laws in Pakistan are governed by The Guardian and Wards Act, 1890 and The Family Courts Act, 1964.
1. Custody of Children:
  • After divorce or separation, the custody of minor children is determined by the court, with a primary focus on the best interests of the child.
  • Mothers usually get custody of younger children, especially daughters, while fathers often retain guardianship and financial responsibility.
  • In cases where both parents are deemed unfit, the court can appoint a legal guardian under The Guardian and Wards Act, 1890.
2. Visitation Rights:
  • Non-custodial parents are usually granted visitation rights, which are regulated by the court to ensure the child maintains a healthy relationship with both parents.
